Spousal Sponsorship Canada — Who Qualifies

Spousal and partner sponsorship falls under IRCC's Family Class immigration program. It allows Canadian citizens and permanent residents to bring their spouse, common-law partner, or conjugal partner to Canada as a permanent resident. It is one of the most frequently used immigration pathways — and one of the most frequently refused due to eligibility errors that could have been caught before filing.

Inland vs. Outland — Choosing the Right Pathway

Inland sponsorship is available when the applicant is physically present in Canada with valid status. It includes the option to apply for an open work permit (OWP) simultaneously, allowing the applicant to work while the application is in process. However, inland applicants generally cannot leave Canada for extended periods during processing without risking application abandonment.

Outland sponsorship is filed when the applicant is outside Canada or the couple chooses outland processing for flexibility. There is no OWP option with a standard outland application, though the applicant can independently apply for a temporary work permit if needed. Outland processing is generally 3–6 months faster than inland.

Can a permanent resident sponsor their spouse if they live outside Canada?

No. Permanent residents must be residing in Canada to sponsor. Only Canadian citizens living abroad may sponsor, provided they intend to return when the sponsored person becomes a PR. A PR who has relocated abroad cannot initiate a sponsorship application until they re-establish Canadian residency.
